By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services
on behalf of an organization, you represent and warrant that you have the authority to bind that organization
to these Terms.
1. Description of Services
SincSports provides online tools and services related to sports event management, including but not limited to
registration, scheduling, communication tools, event websites, scoring, reporting, and related features.
The Services may change or evolve over time, and SincSports reserves the right to modify or discontinue
any portion of the Services at any time.
2. Accounts and Responsibilities
You are responsible for maintaining the accuracy of all information associated with your account and for all
activity conducted under your account. You agree to ensure that all users accessing the Services under your
organization comply with these Terms.
3. Fees and Invoicing
Certain Services require payment of fees. Unless otherwise agreed to in writing:
- Invoices are issued following completion of an event or service.
- Payment Terms: Net 30 (payment is due thirty (30) days from the invoice date).
All fees are non-refundable unless expressly stated otherwise in writing.
4. Late Fees and Non-Payment
Any undisputed balance remaining unpaid more than sixty (60) days after the invoice date may,
at SincSports' option, be subject to a late fee equal to one and one-half percent (1.5%) per month
(18% annually), or the maximum rate permitted by applicable law, calculated monthly on the outstanding
balance until paid in full.
Continued non-payment may result in account holds, suspension of Services, modification of payment terms
for future events, or other collection actions permitted by law.
You agree to reimburse SincSports for all reasonable costs incurred in collecting past-due amounts, including
administrative costs, collection agency fees, and reasonable attorneys' fees, to the extent permitted by law.
5. Cancellations, Weather, and Event Changes
Events may be subject to changes, delays, rescheduling, or cancellation due to weather, facility availability,
safety concerns, or other circumstances beyond SincSports' control.
SincSports offers event organizers the option to purchase event cancellation insurance at the time of
registration or contracting. If such insurance is purchased, refunds for cancelled events are governed
solely by the terms and conditions of the applicable insurance policy.
If an event is cancelled due to weather-related circumstances and event cancellation insurance has
not been purchased, SincSports may, at its discretion, permit the event to be rescheduled
one (1) time within sixty (60) days of the original event date, subject to availability and operational
considerations.
Except as expressly provided above or agreed to in writing, all fees paid to SincSports are non-refundable,
and SincSports shall not be responsible for losses, damages, or expenses arising from event cancellations,
delays, or modifications.
6. Acceptable Use
You agree not to:
- Interfere with or disrupt the Services
- Attempt unauthorized access to systems or data
- Use the Services for unlawful or abusive purposes
- Copy, scrape, or reverse engineer any portion of the Services
SincSports reserves the right to suspend or terminate access for violations of this section.
7. Intellectual Property
All content, software, designs, and materials provided through the Services are owned by or licensed to SincSports
and are protected by intellectual property laws. You retain ownership of content you submit but grant SincSports
a non-exclusive, royalty-free license to use such content solely in connection with providing the Services.
8. Privacy, Cookies, and SMS Communications
SincSports' collection and use of personal information is governed by its Privacy Policy, Cookie Policy, and SMS
Terms of Service, which are incorporated into these Terms by reference.
9. Disclaimers
The Services are provided on an “as is” and “as available” basis. SincSports makes no warranties, express or implied,
regarding the Services, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, SincSports shall not be liable for any indirect, incidental, special, consequential,
or punitive damages, including loss of revenue, data, or business opportunities, arising out of or related to the use of the Services.
In no event shall SincSports' total liability exceed the amount paid by you to SincSports for the Services giving rise to the claim
during the twelve (12) months preceding the event giving rise to liability.
11. Indemnification
You agree to indemnify and hold harmless SincSports from any claims, damages, liabilities, costs, or expenses arising from your
use of the Services, violation of these Terms, or violation of any applicable law.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard
to conflict of law principles.
13. Modifications to Terms
SincSports may update these Terms from time to time. Continued use of the Services after changes become effective constitutes
acceptance of the revised Terms.
